TikTok’s parent company ByteDance is fighting hard not to be banned in the US.
The Ban Is Called ‘Anti TikTok’
ByteDance’s attempts to appeal the ban to the court were rejected without result. It is only a matter of time before the law comes into force. At the moment, they have almost no options to stop the blocking.
ByteDance had submitted an appeal to the court in April, declaring that the banning of TikTok violated freedom of expression and equal protection principles. But the panel of 3 judges ruled that there was no violation and that it was in accordance with the Constitution.
The decision paved the way for the law signed by US President Biden in April, forcing TikTok to sell its operations. ByteDance has until 19 January 2025 to dispose of TikTok.
Trump had previously opposed the removal of TikTok from the US Market. It is also possible to say that ByteDance supports Trump’s presidential candidacy so that TikTok is not blocked in the USA.
The Constitution allows the US President to grant 90-day extensions in such cases, but this provision usually applies to companies that are moving towards divestment. The biggest uncertainty at the moment stems from the change in management.
In its constitutional challenge, TikTok claimed that it operated independently of its Chinese parent company ByteDance and never shared US data with Chinese servers. However, these claims were insufficient to convince the US delegation. Although the US Constitutional delegation claimed that TikTok operates independently from ByteDance, China thinks that they will obtain this data using their own laws.
It remains unclear how much Trump, who will become President on 19 January 2025, will get for TikTok. If TikTok does not strengthen its evidence, it will be inevitable to block TikTok in the USA. China should take some initiative to prevent China from taking data using its own laws, and this initiative should convince the Board of evidence.
